This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It sets out the records Glyde X (Pty) Ltd holds and how you may request access to them. It also describes, for the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), the personal information we process and why.

You do not need a reason to ask us for a record. You do need to follow the procedure below, and we have to answer within the time the Act allows.

2. Head of the private body and Information Officer

The head of the private body for the purposes of PAIA, and the Information Officer for the purposes of POPIA, is the owner of the business.

3. The Information Regulator’s guide

Section 10 of PAIA requires the Information Regulator to publish a plain-language guide explaining how to use the Act. That guide is not written by us and it is free. You can get it from:

4. Records we hold

Not every record below exists at any given time, and holding a record does not mean it is automatically available. Section 6 explains the grounds on which access may be refused.

Customer records Quotations, orders, invoices, proof of payment, delivery and collection records, warranty and repair records, and correspondence including email and WhatsApp messages
Supplier and contractor records Purchase orders, supplier invoices, contracts and correspondence
Employment records, where applicable Contracts of employment, payroll and payslips, statutory deductions, leave and attendance records, and disciplinary records
Website and marketing records Website content and orders placed online, mailing list entries, and visitor statistics
Insurance records Policies, schedules and claims
Data protection records Records of PAIA requests, POPIA consents and objections, and any reported security compromises

5. Records kept in terms of other legislation

Where applicable to the company, records are kept under, among others:

  • Income Tax Act 58 of 1962 and the Tax Administration Act 28 of 2011
  • Value-Added Tax Act 89 of 1991, if and when the company is registered for VAT

6. How to request a record

  1. Complete the prescribed request form (Form C) published in the PAIA Regulations. It is available from the Information Regulator at inforegulator.org.za, and we will email it to you on request.
  2. Give enough detail to identify the record and to identify yourself, and say how you would like to receive it.
  3. If you are asking on behalf of somebody else, attach proof that you are authorised to do so.
  4. Say which right you are seeking to exercise or protect, and why the record is needed for that. PAIA requires this of a request to a private body.
  5. Send the form to the Information Officer at the address in section 2.
  6. We will respond within 30 days, as the Act requires. That period may be extended in the circumstances PAIA allows, and we will tell you in writing if it is.

Fees. PAIA allows a private body to charge a request fee and an access fee at the rates prescribed in the PAIA Regulations. Those rates are set by regulation and change from time to time, so we do not reproduce them here. We will quote you the applicable fee in writing before doing the work, and we will not begin until you have agreed to it. No fee is payable for a request for your own personal information.

7. When access may be refused

Chapter 4 of PAIA sets out the grounds on which a private body must or may refuse access. In summary, these include the protection of somebody else’s personal information, commercial information belonging to us or to a third party, information given to us in confidence, records privileged in legal proceedings, and research information. If we refuse, we will tell you in writing which ground we are relying on and how to challenge it.

8. If you are unhappy with our decision

You may lodge a complaint with the Information Regulator using the details in section 3, and thereafter apply to a court. Nothing in this manual limits any right you have under PAIA, POPIA, the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.

9. Personal information we process, for POPIA

Whose information Customers and enquirers, suppliers and contractors, and employees where applicable
What we process Name, delivery and billing address, telephone number, email address, order and payment history, and correspondence
Why To quote for, sell, deliver, install and guarantee furniture; to keep accounting and tax records; and to answer questions
Who else sees it Delivery contractors, our accountants and bank, and our website and email providers, each only so far as needed
Security Access is limited to those who need it, the website is served over HTTPS, and administrative access is password protected

This manual is available free of charge on this website and at our premises during business hours. We will email a copy on request.
